REGULATORY COMPLIANCE DECLARATION: Fleet communications infrastructure operates across both the Private Land Mobile Radio Services (
47 C.F.R. Part 90) and the Amateur Radio Service (
47 C.F.R. Part 97). All commercial frequencies are keyed exclusively via FCC Part 90 type-accepted hardware. In full conformity with
47 C.F.R. § 97.113(a)(4), amateur transmissions remain strictly unencrypted; cryptographic measures are deployed exclusively for station telecommand, digital authentication, and fail-safe shutdown links under
§ 97.211 and
§ 97.213.

Under long-standing FCC policy and technical directives, the cross-utilization of equipment between Part 90 and Part 97 is governed by the following operational boundaries:
- Part 90 Equipment in the Amateur Service: Type-accepted commercial transceivers (Kenwood NX-series, AnyTone, and TYT commercial units) are fully authorized for operation on amateur frequencies. Part 97 places technical burdens (spectral purity, harmonic suppression, spurious emissions under 47 C.F.R. § 97.307) on the licensee rather than requiring mandatory amateur certification. Part 90 commercial type-acceptance exceeds Part 97 emission standards.
- Amateur Equipment Restriction: Equipment lacking an official FCC Part 90 Grant is strictly software-inhibited and blocked from transmitting on any Part 90 commercial pool frequencies.
- Channel Separation & Memory Partitioning: Fleet transceivers utilize strict codeplug partitioning, segregating Part 90 business frequencies from Part 97 amateur repeater and simplex channels into separate display zones.
¶ 3. Cryptographic Protocols & Telecommand Carve-Out Declaration
In full accordance with Federal Communications Commission regulations, all RF transmissions generated across fleet stations strictly maintain separation between open payload traffic and encrypted command infrastructure:
